Terms of Use & Entry
By booking, entering and/or using The Badminton Club venue or facilities, entrants agree to abide by the following conditions:
Risk Warning
Entrants acknowledge that badminton and related activities involve risks, including serious injury and death. By entering and participating, entrants accept these risks in accordance with the Civil Liability Act 2002 (NSW).
Waiver of Liability – Recreational Services
To the maximum extent permitted by law, including under section 5N of the Civil Liability Act 2002 (NSW) and section 139A of the Competition and Consumer Act 2010 (Cth):
- The Badminton Club (TBC) excludes liability for death or personal injury arising from the supply of recreational services.
- This exclusion does not apply to significant personal injury caused by reckless conduct of TBC.
Indemnity (Entrants’ Conduct Only)
- Entrants agree to indemnify and hold harmless TBC and its employees, representatives, and agents from any loss, liability, expense, claim, or damage to the extent caused by the entrant’s own acts, omissions, or breach of these Terms.
- This indemnity does not apply to the extent loss is caused or contributed to by TBC’s own negligence, breach of law, or reckless conduct.
Insurance
TBC recommends that entrants obtain appropriate personal or sporting injury insurance to cover their participation.
Medical Assistance
Entrants authorise TBC to obtain medical assistance, treatment, or transport as deemed reasonably necessary. Entrants acknowledge that they will be responsible for all costs associated with such treatment or transport.
Behaviour and Compliance
Entrants must behave appropriately and follow the lawful directions of TBC at all times.
- Not engage in derogatory comments, abusive language, or disruptive behaviour.
- Not damage TBC property (and must make good any damage caused).
- Comply with all applicable safety and venue rules.
- TBC reserves the right to refuse entry to, or remove, any person from the venue.
- Loud music is not permitted.
- All shuttles used during gameplay must be placed in the shuttle bins provided after use.
- Any rubbish must be placed in rubbish bins provided.
Property
Entrants are responsible for their own property at all times. TBC accepts no responsibility for stolen, lost, or damaged property within its facilities, including amenities.
Access and Bookings
- Entrants must use the Access Pin-pad to check in before using the courts and facilities.
- Courts must be booked and paid for in advance.
- Members are responsible for the payment of their guests’ fees.
- Entrants must strictly adhere to their allocated time slot and court number. Additional time may be booked and purchased via TBC’s website
Coaching and Attire
- Only authorised TBC coaches are permitted to provide badminton lessons or use coaching equipment.
- Entrants must not receive coaching at TBC except from an authorised TBC coach.
- Appropriate attire must be worn at all times, including shirts and non-marking footwear on courts
Recording and Security
- The use of cameras, mobile phones, or other recording devices is prohibited without TBC’s prior written consent.
- CCTV operates throughout TBC facilities, and entrants acknowledge they may be recorded.
Smoking and Alcohol
- Alcohol consumption is not permitted in any part of the venue.
- Smoking is prohibited in all areas of TBC.
